Terms of Use

By downloading, accessing, or using Nova Muse (the “App”), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the App.

These Terms form a binding agreement between you and Asif Mustafayev, the independent developer of Nova Muse, based in Azerbaijan (“we,” “us,” “our”).

Nova Muse is rated for and intended for people aged 17 and older. By using the App, you confirm that you are at least 17 years old and legally able to enter into this agreement. You are responsible for complying with any laws that apply to you where you live.

Nova Muse is an entertainment app. You choose a sample look or effect, add your own photo or video, and our servers apply an AI transformation and return the result to your device.

Results are generated for fun and creativity. They are produced by automated AI processes and may be unexpected, stylized, or unrealistic. Nova Muse is not intended for identification, verification, or any professional, legal, or medical purpose.

To use the App you may choose a username. You are responsible for the activity that happens under your username. You agree not to impersonate anyone, and not to choose a username that is offensive, misleading, or that infringes someone else's rights or trademarks.

We may reclaim or change a username that violates these Terms or that is dormant.

You keep full ownership of the photos and videos you upload (“Your Content”). We do not claim any ongoing rights to it.

You grant us a limited, non-exclusive, temporary license to store and process Your Content solely to generate your result. This license exists only for as long as we hold the media — that is, until it is permanently deleted within 24 hours — and then it ends automatically.

When you upload media, you represent and warrant that:

• You own the rights to it, or otherwise have permission to use it;
• It depicts you, or a person aged 17 or older who has given you their consent to be processed in this way;
• You will not upload images or video of other people without their permission, and never of minors;
• Your Content is not unlawful, hateful, harassing, defamatory, or sexually explicit involving real people without consent;
• You will not create content intended to deceive, defraud, or impersonate, including misleading “deepfake” material.

You agree not to use Nova Muse to:

• Break any applicable law or regulation;
• Create or share non-consensual intimate imagery, or any sexual content involving real people without consent;
• Create any content that sexualizes or endangers minors;
• Harass, threaten, defraud, or impersonate any person;
• Reverse-engineer, scrape, overload, attack, or otherwise disrupt the App or our servers;
• Circumvent the 17+ age requirement or any safety measure.

Violating these rules may result in suspension or termination of your access.

The App, its name and branding, the sample videos and photos, the AI models, and the design are owned by us or our licensors and are protected by intellectual-property laws. They are provided for your personal, non-commercial use within the App.

You may not copy, redistribute, resell, or commercially exploit the sample content or the App except as expressly allowed here.

Outputs you generate are for personal entertainment. You are responsible for how you use or share them, including respecting the rights, reputation, and privacy of anyone depicted, and complying with the rules of any platform where you post them.

Your uploads and your generated results are permanently deleted within 24 hours, and deletion is irreversible. We keep no long-term archive of your media. See our Privacy Policy for full details.

Any paid features or subscriptions are sold through the Apple App Store. Billing, renewals, and refunds are governed by Apple's terms, and we do not process or store your payment details. Refund requests must be made to Apple through your App Store account.

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. AI-generated outputs may be inaccurate, unexpected, or unrealistic, and we do not guarantee any particular result, uptime, or fitness for a specific purpose.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability for any claim is limited to the amount you paid us (if any) for the App in the twelve months before the claim, or USD 50, whichever is greater.

You agree to indemnify and hold us harmless from claims arising out of Your Content or your misuse of the App, to the extent permitted by law.

We may suspend or terminate your access if you breach these Terms or misuse the App. You may stop using Nova Muse at any time. Sections that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will continue to apply.

The following applies because Nova Muse is distributed through Apple:

• These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide any maintenance or support for the App.
• To the extent permitted by law, any product warranty claim, and any claim that the App fails to conform to legal or regulatory requirements, may be your responsibility to address with us, not Apple.
• Apple is not responsible for addressing any third-party claims relating to the App or your use of it, including product-liability and intellectual-property claims.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

These Terms are governed by the laws of the Republic of Azerbaijan, without regard to its conflict-of-laws rules. Disputes will be handled by the competent courts of Azerbaijan, except where mandatory consumer-protection law in your country of residence grants you other rights.

We may update these Terms as the App evolves. If we make a material change, we will update the effective date above. Continuing to use the App after a change means you accept the updated Terms.
